Lawsuit: Tampa Mental Health Facility Staff Ignored Man’s Pleas Before Fatal Restraint

TAMPA, Fla. — Civil rights attorney Ben Crump and co-counsel filed a wrongful death lawsuit Monday against a Tampa mental health facility after a patient died Civil rights attorney Ben Crump and co-counsel have filed a wrongful death lawsuit against Ibis Healthcare, Inc., a Tampa mental health facility after a patient died from physical restraint during a crisis. The lawsuit accuses Ibis healthcare, Inc. of negligence, reckless conduct, and violating state mental health laws. Edward McCloud, a father of two, had been admitted to the crisis stabilization unit on March 8 under Florida’s Baker Act for treatment of schizoaffective disorder and became agitated when his parents arrived to visit him. The complaint alleges that McCloud was restrained face-down on the floor, held in a seclusion room, and left unresponsive for more than 17 minutes before staff began chest compressions. An autopsy listed the cause of death as mechanical asphyxiation from compression of the torso. The Florida Agency for Health Care Administration investigated the facility weeks later and issued a moratorium on new admissions to the facility.
